Shenzhen Court of International Arbitration

(GBA International Arbitration Center, SCIA)

Founded in 1983, the Shenzhen Court of International Arbitration (also known as the South China International Economic and Trade Arbitration Commission and the Greater Bay Area International Arbitration Center, formerly known as the South China Sub-Commission of CIETAC and the Shenzhen Sub-Commission of CIETAC, hereinafter referred to as “SCIA”) is the first arbitration institution in the Guangdong-Hong Kong-Macao region. It symbolizes China’s reform and opening-up, the development of the Shenzhen Special Economic Zone, and the cooperation between Mainland China, Hong Kong, and Macao .

In 1984, SCIA was the first to include foreign arbitrators in its Panel of Arbitrators. In 1989, an arbitral award rendered by SCIA became the first arbitral award from China to be recognized and enforced in a foreign jurisdiction (i.e., Hong Kong), in accordance with the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention). In 2012, SCIA pioneered the establishment of a statutory entity governance mechanism and a corporate governance structure with an international council acting as the decision-making body. In 2016, SCIA became the first arbitration institution in Mainland China to accept investment arbitration cases by updating its arbitration rules. In 2021, under the national development strategy of the Guangdong–Hong Kong–Macao Greater Bay Area (GBA), SCIA added “Greater Bay Area International Arbitration Center” as one of its official names to deepen cooperation with the Hong Kong and Macao Special Administrative Regions, with the goal of jointly developing into an international arbitration center. To date, its arbitration and mediation services have extended to 140 countries and regions worldwide, and its panel of arbitrators covers 114 countries and regions. The highest amount in dispute in a single case in 2022 reached RMB 24 billion, marking a milestone in the history of arbitration in China.

Headquartered in Qianhai and Futian, SCIA has developed three professional industry branches:

South China International Arbitration Center (HK) (SCIAHK)

The South China International Arbitration Center (HK) (SCIAHK), established in Hong Kong in 2019, is an international arbitration institution operating under the laws of the Hong Kong Special Administrative Region (HKSAR). As confirmed by the Supreme People’s Court and the Department of Justice of the HKSAR Government, SCIAHK has been included in the list of qualified arbitration institutions under the Arrangement Concerning Mutual Assistance in Court-Ordered Interim Measures in Aid of Arbitral Proceedings (the “Interim Measures Arrangement”) as a Hong Kong arbitration institution.

Based on the UNCITRAL Arbitration Rules (2013 edition), SCIAHK formulates its own arbitration rules—the SCIAHK Arbitration Rules—which take into account the UNCITRAL Recommendations to assist arbitral institutions and other interested entities regarding arbitration under the UNCITRAL Rules. SCIAHK seeks to follow the text of the UNCITRAL Arbitration Rules faithfully, introducing changes where appropriate to meet the needs of an institutional environment.

The SCIAHK Panel of Arbitrators includes legal professionals and industry experts with experience in international arbitration from major jurisdictions around the world. Highlighting both Hong Kong and international practices, its “recommended list + open choice” approach maximizes party autonomy, allowing parties to appoint arbitrators either from within or outside the recommended panel.

With the latest developments in modern international arbitration rules, SCIAHK is service-oriented, offering impartial, efficient, and flexible arbitration, mediation, and other diversified dispute resolution services for parties from different jurisdictions. SCIAHK is headquartered on the 57th floor of Two International Finance Centre (Two IFC), in the legal and financial hub of Central, Hong Kong, providing world-class hearing facilities and personalized case management for parties worldwide. Parties may appoint arbitrator(s) within the recommended panel of arbitrators or outside the panel.
